City Wins Lawsuit Over Brown Property

Brown Property Lawsuit Dismissed in Favor of City

The City of Bee Cave has won its lawsuit on appeal related to city-owned land known as the Brown Property.

A group called Citizens for the Preservation of the Brown Property (CPBP) sued the City of Bee Cave in 2023 to stop a road project that would have used the northern portion of the Brown Property, which is located near Highway 71 and Great Divide Drive .

On April 3, 2025, the Texas Court of Appeals ruled in favor of the City. Specifically, the court ruled the trial court didn’t have the authority to hear the case.

The appeals court overturned the trial court’s decision and dismissed the case.

The CPBP still has the ability to file an appeal to the Texas Supreme Court.
